Georgia enacted strong tort reform in 2005 and although many portions have been found unconstitutional several portions remain on the books. The statute of limitations in the state bars claims from being brought more than two years after the date of of the injury with no more than five years after the date of the event that caused it. Claims arising from retained objects during surgery are allowed within one year of discovery.In addition, the limits are modified for minors with the statues not beginning until their seventh birthday and the mentally ill (who are shielded from limitations until deemed competent).
Tort reform protects nurses from joint and several liability by limiting their responsibility for any claims to the percent they are deemed liable.
