New York Malpractice Premiums for Full Time Employed Registered Nurses
The New York nursing community have it better than the physicians who have extremely limited malpractice insurance options. Nurses who are less than 50% liable for an injury are responsible for only their share of the verdict or settlement. Also, the state has imposed a two year statute of limitations to bring suit over a medical injury. This two year limit does not apply to retained foreign objects or minors/mentally impaired persons. Patients who have had a foreign object left in them have two years to bring suit or one year after the object is discovered. Minors and those judged insane have two years from this “disability” is removed or up to ten years.
