Ohio Malpractice Premiums for Full Time Employed Registered Nurses
Ohio had significant tort reform in 2002 but has yet to have a meaningful constitutional challenge to uphold it. The state enjoys caps on non-economic damages and defendants are only responsible for their share of liability (many states can make a nurse 1% at fault liable for the entire verdict). Lawsuits must be brought within one year of discovery, although they must be discovered within four years of the event except in cases of objects left during surgery. This does not apply to minors or those of “unsound mind”. A Second exception is that wrongful death cases can be brought within two years of the claimants passing.
