Virginia Malpractice Premiums for Full Time Employed Registered Nurses
The state of Virgina generally bars malpractice cases more than two years after the treatment ended. However, for cases involving foreign bodies retained during surgery the patient has one year from discovery to sue (up to ten years from the actual event). Minors have five years to bring claims for medical expenses and are given until their tenth birthday if they are under the age of eight. Those deemed incapacitated have two years from the time their incapacity is removed to bring a lawsuit.
Virginia has joint and several liability and nurses can be held responsible for an entire judgement amount if they are found partially liable.
